DS-5535 "Supplemental Questions for Visa Applicants"
The DS-5535 is an internal form or questionnaire that asks for additional information.
The DS-5535 is used whenever the U.S. consulate wants to conduct additional checks on the visa application – beyond the information provided in the standard application form. The U.S. visa is then initially rejected in accordance with section 221(g) of the Immigration and Nationality Act (INA) and subject to administrative processing. In the course of this further security check, the applicant must provide any missing or additional information using the DS-5535 form. Based on the information provided, the U.S. consulate then makes a final decision on the visa application.
What happens after filling in the DS-5535?
Usually, the information or the completed DS-5535 form can be sent to the U.S. consulate by e-mail.
Unfortunately, the processing can take several weeks, sometimes even months, and can lead to considerable delays
When and why was the DS-5535 introduced?
The DS-5535 form is the result of a directive issued by U.S. President Trump on March 6, 2017 to improve the screening of visa applicants, and an internal instruction to U.S. consulates worldwide dated March 17, 2017 to ensure a more comprehensive screening of applicants.
A direct relation to President Trump's suspended Executive Order of January 27, 2017 can be seen. As with the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015, the focus is on (dual) nationals of the following countries:
Iran, Iraq, Libya, North Korea, Somalia, Sudan, Syria, Yemen
But other nationalities such as Russia or China are also more stronlgy affected. Moreover, previous trips to countries that are problematic for the United States may also lead to additional security checks.
The DS-5535 was intended to be introduced for an initial period of six months and to be used exclusively in the consular application process. The use of DS-5535 has been extended for another three years and will thus be used until at least 2020 in cases where additional information is requested from the applicant.
Under the new U.S. President Joe Biden, the responsible U.S. authorities are to review, among other things, the DS-5535 form for reasonableness or efficiency during a transitional phase of 120 days, so changes could occur here in the future.
