On April 22, 2020, President Trump issued a proclamation temporarily suspending the entry of individuals seeking to enter the United States as U.S. Permanent Residents for a 60 day period. The proclamation goes into effect at 11:59 p.m. Eastern Daylight Time on Thursday, April 23, 2020. At this time, the proclamation only applies to individuals seeking to enter the U.S. as U.S. Permanent Residents. The proclamation does not impact individuals who are currently in the U.S. seeking to adjust status to U.S. Permanent Resident nor does it impact non-immigrant visa holders (e.g. F-1 Students, J-1 Exchange Visitors, H-1B Employees, B visas, etc.) for the period of their authorized stay in the U.S. Non-immigrant visa holders may continue to seek an extension or change of non-immigrant status in the U.S. for which they are otherwise eligible.
Exclusions and/or Exceptions to the proclamation:
• U.S. Lawful Permanent Residents
• Foreign nationals seeking to enter the U.S. on immigrant visa as a physician, nurse, or other healthcare professional; to perform medical research; to perform other work essential to combatting COVID-19; and, any accompanying spouse and unmarried child under the age of 21
• Applicants under the EB-5 Immigrant Investor Program
• Spouses of U.S. Citizens
• Children under age 21 and are children of a U.S. Citizen or are prospective adoptees
• Individuals whose entry would further U.S. law enforcement objectives as determined by the Secretaries of State and Homeland Security
• Members of the U.S. armed forces and their spouses and children
• Foreign nationals seeking entry pursuant to a Special Immigrant Visa and their spouse and children
• Foreign nationals whose entry would be in the U.S. national interest as determined by the Secretaries of State and Homeland Security
