Arkadaşlar kararın 2021 kazananlarının durumuna bir etkisi oldu mu veya ilerde olma ihtimali var mı?
2021i etkileyip etkilemediği henüz belli değil aslında. Dv2020 yazmış kararında sürekli, DV değil. Muhtemelen bunu net olarak 25 Eylülde öğreneceğiz.
Ama kendi çıkarımım:
Dv2020'yi EO dışına çıkartmasının sebebini son tarihin yaklaşmış olması şeklinde yazmış. Diğer vize türlerini (aile birleşmeleri gibi) EO dışına çıkartmamış çünkü onlar için bir "deadline" söz konusu değil.
Şimdi buradan 2 çıkarım yapıyorum.
1- DV2020yi EO dışına çıkartmasının sebebi son tarihin yakın olması ise Ocaktan sonra DV2021 için hala 9 ay süre kalıyor olduğu için DV2021 bu karardan etkilenmemiştir. Yani yine Ocakta başlar.
2- DV2020yi EO dışına çıkartmasının sebebi bir son tarihinin "var olması" ise o zaman DV2021 de etkilenmiştir çünkü her ne kadar çok yakın bir tarih olmasa da sonuçta bir "deadline" var. Öyleyse Ekim'de başlar.
Kararını anlamak için ya talihli arkadaşların mülakat maili almasını ya da 25 Eylülü bekleyeceğiz

As you should be aware on Friday September 4, Judge Mehta issued an order to the Department of State which directs the agencies such as DoS, KCC and the embassies to process and adjudicate DV2020 cases by the September 30th deadline. Judge Mehta has asked for a report of progress (including actions taken or not taken) for review on September 25th.
Additionally Judge Mehta found the following:
(1) the State Department’s policy of not reviewing and adjudicating non-exempt visas
is not in accordance with law, is in excess of statutory authority, and is arbitrary and capricious;
(2) the State Department’s non-processing of 2020 diversity visa applications constitutes agency
action unreasonably delayed; and (3) the State Department’s exclusion of 2020 diversity visa
applications from its guidance on mission critical services is arbitrary and capricious.
He then ordered:
“Defendants shall undertake good-faith efforts, directly and through their designees, to expeditiously process and adjudicate DV-2020 diversity visa and derivative beneficiary applications and issue or reissue diversity and derivative beneficiary visas to eligible applicants by September 30, 2020”
Given this judgement from the Federal court, which has jurisdiction in these matters, I am contacting you to request your immediate cooperation so that my case can be adjudicated by the deadline and according to the order of the judge.

@yigitroun Dv 2020 için dağıtılması düşünülen vize sayısı 54650 olarak açıklanmıştı, bunlardan 12322 adedi dağıtıldı, refused+Ap =4869 (maalesef ap sayısını mart 2020den itibaren ap lerin refused olarak gösterilme karar verilmesinden dolayı tam olarak bilemiyoruz yoksa refused sayısı bizi ilgilendirmiyor ama ap sayısı için vize saklanabilir bunun için kalan vize sayısından ap miktarını çıkarılması gerekir)
Ama bildiğimiz verilerden yorumlarsak 54650 - 12322 =42328 dağıtabilecek vize kalır elimizde, bunun 2 bin küsürunu ap diye ayırsak bile toplam 40 bine yakın ellerinde vize var diyebiliriz

Dear Sir/Madam,
As you should be aware on Friday September 4, Judge Mehta issued an order to the Department of State which directs the agencies such as DoS, KCC and the embassies to process and adjudicate DV2020 cases by the September 30th deadline. Judge Mehta has asked for a report of progress (including actions taken or not taken) for review on September 25th.
Additionally Judge Mehta found the following:
(1) the State Department’s policy of not reviewing and adjudicating non-exempt visas
is not in accordance with law, is in excess of statutory authority, and is arbitrary and capricious;
(2) the State Department’s non-processing of 2020 diversity visa applications constitutes agency
action unreasonably delayed; and (3) the State Department’s exclusion of 2020 diversity visa
applications from its guidance on mission critical services is arbitrary and capricious.
He then ordered:
“Defendants shall undertake good-faith efforts, directly and through their designees, to expeditiously process and adjudicate DV-2020 diversity visa and derivative beneficiary applications and issue or reissue diversity and derivative beneficiary visas to eligible applicants by September 30, 2020”
Given this judgement from the Federal court, which has jurisdiction in these matters, I am contacting you to request your immediate cooperation so that my case can be adjudicated by the deadline and according to the order of the judge.
